Form I-9 and Everify 2025 Changes

Recent changes to Form I-9 and E-Verify include updated language to reflect statutory changes and the introduction of remote document verification for some employers. Additionally, E-Verify is implementing multi-factor authentication to enhance account security. 

Key Changes and Updates:

Updated Language:

The selection “A noncitizen authorized to work” on Form I-9 and E-Verify will be updated to “An alien authorized to work,” reflecting statutory changes. 

Remote Document Verification:

E-Verify employers can now remotely examine Form I-9 documents as part of the verification process. 

Multi-Factor Authentication (MFA):

E-Verify is implementing MFA through Login.gov to improve security. 

I-9 Electronic Signatures:

Employers can use electronic signatures on Form I-9 in compliance with the ESIGN Act. 

Form I-9 Updates:

The I-9 form and instructions have been shortened, with a newer version available for use. 

Important Considerations:

E-Verify+:

E-Verify+ allows employers to initiate cases in E-Verify after accepting a job offer, with employees sharing information electronically, according to E-Verify

Reverification:

Employers must complete Supplement B of Form I-9 for reverification when temporary employment authorization expires, according to E-Verify

Penalties:

Penalties for I-9 and E-Verify violations, including intentional violations, can be substantial, and are expected to increase in the future.
